Agreement

These Terms of Use govern your use of the Verde app. By downloading or using Verde you agree to them. If you do not agree, do not use the app.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Verde on Apple devices you own or control, in line with the Usage Rules of the Apple Media Services Terms and Conditions. You may not sell, rent, sublicense or redistribute the app, and you may not reverse-engineer, decompile or attempt to derive its source code except where that restriction is prohibited by law.

Your Photos and Your Rights in Them

You keep ownership of the photos you upload. By uploading a photo you confirm that you have the right to use it, and you grant us the limited permission needed to store it and process it so the app can generate your designs. That permission exists only to run the service for you — as set out in the Privacy Policy, your photos are not sold and are not used to train models.

Do not upload photos of places you have no right to photograph, images containing other people who have not agreed to it, or content that is unlawful, infringing or offensive.

What a Design Is — and Is Not

Verde produces a visualisation of how a space could look, together with suggested plants, suggested materials and an approximate cost range. These outputs are generated automatically and are estimates and suggestions only.

• They are not architectural, structural, horticultural or engineering advice.
• They are not construction drawings, and they are not a quotation.
• Plant suggestions may not suit your exact soil, microclimate or local restrictions, and some species may be regulated or invasive where you live.
• Cost ranges are indicative and will not match a real quote in your market.
• Permits, building regulations, setback rules, tenancy agreements and homeowners' association rules are your responsibility to check.

Before you build, dig, or remove anything, confirm the plan with a qualified professional and check what is under the ground.

Free Designs and Subscriptions

Verde includes a number of free designs so you can see the result before paying for anything. When those are used, you can subscribe to Verde Plus.

• The exact price and the exact number of designs the plan includes are shown on the purchase screen, before you pay.
• Payment is charged to your Apple account at confirmation of purchase.
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price shown for your plan.
• You can manage or cancel your subscription in your Apple account settings at any time.
• Refunds are handled by Apple under Apple's refund policy; we cannot issue App Store refunds ourselves.

If a plan's price or included design count changes, the change applies to future periods and is shown to you before it takes effect.

Acceptable Use

Use Verde lawfully. Do not attempt to overload, attack or circumvent the service or its usage limits, do not use automated means to generate designs at scale, and do not use the app to produce content that is unlawful or that infringes someone else's rights.

Availability and Changes

Verde depends on network services and on a third-party AI model provider. We may update, change or discontinue the app or any of its features, and generation may occasionally be slow, unavailable, or produce a result you are not happy with. We do not promise that the app will always be available, uninterrupted or error-free, and results will vary with the quality of the photo you provide.

Disclaimer of Warranty

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, wasted expenditure, construction or landscaping costs, plant losses, or damage arising from work carried out on the basis of a generated design. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

Termination

You may stop using the app at any time by deleting it; cancelling a subscription is done separately in your Apple account settings. We may suspend or end your licence if you breach these terms. The disclaimer, limitation of liability and any other sections that by their nature should survive will continue to apply after termination.

Apple

This agreement is between you and us, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Privacy

Our handling of your data is described in the Privacy Policy, which forms part of these terms.

Changes to These Terms

If these terms change materially, the update will be reflected on this page with a new "last updated" date and announced in the app's release notes. Continuing to use the app after a change means you accept the revised terms.
